Product Liability
Product liability law makes the manufacturers, distributors, and sellers of products responsible for delivering safe items to consumers. It also requires that the manufacturers, distributors, and sellers of defective products correct any defects revealed and make good on that responsibility.
Virginia law permits a plaintiff to file a lawsuit against the product’s designer, manufacturer, distributor, wholesaler, or seller, depending on the circumstances. You do not have to be the purchaser of the product to file suit. In other words, the law is designed to assure Virginians that unsafe products have a limited shelf life, and that those who sell them can be held responsible for their wrongful, negligent actions.
If you suffer an injury because a product did not live up to its warranty, you may have a strong product liability claim. Be forewarned, however, there is a two-year statute of limitations in certain circumstances.
